Federal Judge Rules Against Trump in Nevada Mail-In Voting Lawsuit

The Trump campaign is facing its own battle in the battleground state of Nevada, as a federal judge just dismissed a lawsuit the campaign filed over Nevada’s new mail-in voting law, according to CBS News. Under the law, Nevada plans to mail paper ballots to all registered active voters statewide, whether they ask for the ballot or not.

“I’m pleased to see a federal court judge has dismissed a lawsuit seeking to block [Assembly Bill 4], a measure passed to expand options for Nevadans and provide for safe, fair & accessible elections during the pandemic” Nevada Governor Steve Sisolak, a Democrat, said on Twitter.

U.S. District Court Judge James Mahan ruled Monday that Republicans failed to establish standing for the lawsuit. As a result, Nevada’s Secretary of State Barbara Cegavske’s will be able to file a motion to dismiss the case. Mahan referred to the Trump’s campaign’s arguments as being “too speculative.” He also said they failed to show there was a “substantial risk” of compromising the election.

Trump has falsely repeated that universal mail-in voting systems, similar to Nevada’s, will lead to voter fraud, according to CNN. Nevada joined other states last month that chose to expand voting by mail in light of the pandemic. Trump immediately spoke out against the measure, accusing Nevada’s governor of using the coronavirus as an excuse “to steal the state.” The Trump campaign now has 30 days to appeal the decision.
