Getty Images Sues Stability AI Over Image Generator

Stock photo behemoth Getty Images has filed a lawsuit against Stability AI, the company behind popular image generator Stable Diffusion AI, accusing the company of copying 12 million images from its collection “without permission” or “compensation.” The lawsuit was filed last week in a U.S. District Court in Delaware, according to Futurism.

“This case arises from Stability AI’s brazen infringement of Getty Images’ intellectual property on a staggering scale,” the lawsuit states.

Getty executives have also alleged that Stability AI went so far as to delete or edit its copyright management data, as well as “provided false copyright management information, and infringed Getty Images’ famous trademarks.” Getty also claims that Stable Diffusion “chose to ignore viable licensing options and long-standing legal protections in pursuit of their stand alone commercial interests.”

“Stability AI was well aware that the content it was scraping without permission from Getty Images’ websites was protected by copyright,” Getty’s complaint states.

Getty Images has requested a jury trial, which it says would help prevent Stability AI from making similar infringements in the future. Getty is also seeking recompense for Stability AI’s infringement on its intellectual property rights and has stated the company wants damages in the case. Their lawyers are asking the court to force “a full and complete accounting to Getty Images for Stability AI’s profits, gains, advantages, and the value of the business opportunities received from its infringing acts.”
